FHCB Affiliate POS App Terms of Use

Welcome to the FHCB Affiliate POS App (the "App"), provided by Family Home Christian Books ("FHCB," "we," "us," or "our").

These Terms of Use ("Terms") govern your access to and use of the App. By downloading, accessing, or using the App, you agree to these Terms and the applicable policies of Family Home Christian Books. If you do not agree, please do not use the App.

The App operates in connection with the Family Home Christian Books website. Our general Website Terms of Use also apply where relevant.

1. Authorized Affiliate Use

The App is designed exclusively for authorized Family Home Christian Books affiliates to place orders on behalf of their customers and manage related sales activities.

By using the App, you agree to:

Use the App only as an authorized FHCB affiliate.
Provide accurate account and customer information.
Obtain appropriate customer authorization before placing orders.
Use customer information only for legitimate FHCB sales and order-related purposes.
Comply with applicable laws and FHCB affiliate program requirements.

The App is not intended for customers to place their own orders or for affiliates to make personal purchases. Affiliates should use the FHCB website for their own purchases.

FHCB reserves the right to restrict or terminate App access if an affiliate violates these Terms or applicable program policies.

2. Affiliate Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account.

You agree to:

Keep your login information secure.
Not share your account with unauthorized individuals.
Notify FHCB promptly if you suspect unauthorized access.
Use reasonable precautions to protect devices used to access customer and order information.

You may not transfer or assign your App account to another person without authorization from FHCB.

3. Customer Orders

Affiliates may use the App to place orders on behalf of customers who have authorized the purchase.

When submitting an order, you are responsible for ensuring that:

Customer names, contact information, and shipping addresses are accurate.
Products, quantities, and order details reflect the customer's instructions.
The customer has approved the purchase and understands the applicable charges.
Payment information is entered with the customer's authorization.

Orders submitted through the App are processed through the Family Home Christian Books online store and are subject to applicable product availability, shipping terms, and order-processing policies.

FHCB reserves the right to review, decline, or cancel orders where necessary, including cases involving suspected fraud, incorrect information, unavailable products, or payment issues.

4. Pricing and Affiliate Commissions

Customers purchasing through the App are charged the regular FHCB website prices, including applicable quantity-based pricing.

Using an affiliate account does not automatically provide customers with additional discounts.

Eligible orders may generate affiliate commissions according to the terms of FHCB's affiliate program.

Commission eligibility, calculation, adjustments, and payment are governed by the applicable affiliate program terms and policies. Returns, cancellations, payment failures, or other adjustments may affect commissions.

Information displayed in the App regarding commissions and order activity is provided for reference and may be updated as transactions are processed or adjusted.

5. Payment Processing

The App supports payment methods made available by Family Home Christian Books.

For credit and debit card transactions, payment-card information is transmitted directly to Authorize.Net for secure tokenization. FHCB's Magento-based online store processes orders using the resulting payment token and its established payment integration.

The App does not intentionally store or log full payment-card numbers or card security codes.

Additional payment options, including Klarna where available, may be subject to separate terms and conditions established by the payment provider.

All transactions are subject to payment authorization and verification. FHCB may decline or cancel an order if payment cannot be successfully completed.

6. Shipping, Returns, and Refunds

Orders submitted through the App are subject to FHCB's existing shipping, return, and refund policies.

Generally, eligible items may be returned within 30 days for a refund of the original purchase price, excluding shipping charges, provided the items are returned in resalable condition with the original paperwork.

Return shipping is normally the customer's responsibility unless an item is defective or FHCB made an error in processing the order.

Opened media products, including DVDs, CDs, and software, are generally eligible only for exchange for an identical product if defective.

7. Customer Information and Privacy

Affiliates may have access to customer information necessary to place orders, review previous transactions, and provide order-related assistance.

You agree to:

Access customer information only for legitimate FHCB business purposes.
Protect personal information against unauthorized access or disclosure.
Not share, sell, distribute, or misuse customer information.
Not attempt to access customer or order records belonging to other affiliates without authorization.
Comply with applicable privacy and data-protection requirements.

Information collected and processed through the App is governed by our FHCB Website Privacy Policy and the FHCB Affiliate POS App Privacy Policy.

8. Acceptable Use

You agree not to use the App in any manner that:

Violates applicable laws or regulations.
Involves fraudulent, unauthorized, or misleading transactions.
Interferes with the App's operation or security.
Attempts to bypass authentication or access restrictions.
Attempts to obtain information not intentionally made available to your account.
Introduces malicious software or otherwise compromises FHCB systems.
Copies, modifies, reverse engineers, or redistributes the App except as permitted by applicable law or with written authorization.

FHCB may investigate suspected misuse and restrict access as reasonably necessary to protect its systems, customers, and affiliates.

9. Intellectual Property

The App and its associated software, design, graphics, logos, text, and other content are owned by Family Home Christian Books or its respective licensors and are protected by applicable intellectual property laws.

FHCB grants authorized affiliates a limited, non-exclusive, non-transferable, revocable license to use the App for its intended business purposes.

This license does not transfer ownership of the App or any associated intellectual property.

You may not reproduce, redistribute, modify, or commercially exploit App content except as expressly authorized by FHCB or applicable law.

10. Third-Party Services

The App may use services provided by third parties, including payment processors, shipping providers, and technology service providers.

These services may be subject to their own terms and privacy policies.

FHCB is not responsible for independent third-party websites or services outside its control, except to the extent required by applicable law.

11. App Availability and Updates

FHCB strives to provide reliable access to the App but does not guarantee uninterrupted or error-free operation.

Features may be modified, temporarily suspended, or discontinued for maintenance, security, technical, or business reasons.

Updates may be required to maintain compatibility, security, or access to particular features.

FHCB is not responsible for service interruptions caused by device incompatibility, internet connectivity, or third-party service failures, except as otherwise required by law.

12. Electronic Communications

By using the App, you agree that FHCB may provide transaction-related communications electronically, including order confirmations, account notices, service updates, and other information necessary to operate the App.

These communications may be delivered through email, the App, or other available electronic methods.

Marketing communications, where offered, are subject to applicable consent and opt-out requirements.

13. Disclaimer of Warranties

The App and its associated services are provided on an "as is" and "as available" basis to the extent permitted by applicable law.

FHCB makes no guarantee that the App will operate without interruption, that every feature will always be available, or that all displayed information will be free from errors.

To the extent permitted by law, FHCB disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties or protections that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, FHCB and its service providers will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the App, including loss of business, profits, or data.

Nothing in these Terms limits liability that cannot legally be excluded or restricted.

15. Suspension or Termination

FHCB may suspend or terminate an affiliate's access to the App when reasonably necessary, including for violations of these Terms, unauthorized activity, security concerns, or termination of affiliate program participation.

Termination of App access does not automatically cancel existing customer orders or eliminate outstanding obligations arising from completed transactions.

16. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Disputes arising from use of the App will be subject to the jurisdiction of the appropriate courts in Michigan, to the extent permitted by law.

17. Changes to These Terms

FHCB may revise these Terms as the App, its features, or applicable requirements change.

Updated Terms will be published on this page with a revised effective date.

Continued use of the App after updated Terms take effect constitutes acceptance of those changes to the extent permitted by applicable law.
